1. About us

JUJE, SELF-MANAGED COMPANY, whose registered office is at LEVALLOIS PERRET (92300) 41 Rue Jean Jaurès, registered in the NANTERRE Trade and Companies Register under number 825 127 103 (hereinafter the "Company"). The Company markets the following products to its Customers via its Website: Sports textile for adults, especially for triathlon, running, swimming or cycling. Accessories related to sport and in particular triathlon.

 

2. Preamble

JUJE invites Users to carefully read these General Terms and Conditions of Sale and Use (hereinafter referred to as the "GTC/GCU"). The placing of an Order implies the acceptance of the GTC/GCU. The characteristics of the Products are indicated on the Website www.juje.fr. It is the Customer's responsibility to take this into account before making a purchase. The photographs or graphics presented on www.juje.fr are not contractual.

The Customer acknowledges having read and accepted them by checking the box provided to do so before placing his Order online or when creating his account. Any order appearing on the website www.juje.fr implies acceptance of these General Terms and Conditions. Any order confirmation implies your full and complete acceptance of these general terms and conditions of sale, without exception or reservation.

The GTC/GCU govern the conditions under which JUJE sells its Products to its Professional and Consumer Customers via its Internet Site www.juje.fr .

They apply to all sales concluded by JUJE and are binding on all contradictory documents, in particular the Client's general terms and conditions of purchase.

They are systematically communicated to the Client upon request.

In the event of a subsequent modification of the GTC/GCU, the Customer is subject to the version in force at the time of his Order.

 

3. Definitions of the terms

"Customer" refers to the Professional or Consumer who has placed an Order for a Product sold on the Website www.juje.fr

"Order" means any order placed by the User registered on this Site;

"General Terms and Conditions of Sale and Use" or "GTC/GTCU" refers to these general terms and conditions of use and online sale;

"Consumer" refers to the buyer who is a natural person and who does not act for professional needs and/or outside his professional activity;

"Products" refers to the material things that can be appropriated and that are offered for sale on this Site;

"Professional" refers to the buyer who is a legal or natural person acting within the framework of his professional activity;

"Site" refers to this WebSite, i. e. www.juje.fr ;

"Company" means JUJE Company, more fully described in Article I hereof; and

"User" refers to any person who uses the Site.

 

4. Registration process

Registration on the Site is open to all legal or natural persons of full age and with full legal personality and capacity.

The use of the Site is subject to the registration of a User. Registration is free of charge.

To proceed with registration, the User must fill in all the mandatory fields; otherwise registration cannot be completed.

Users guarantee and declare on their honour that all information communicated on the Site, in particular during registration, is accurate and compliant. They undertake to update their personal information from the page dedicated to them and available in their account.

All registered users have a username and password. The latter are strictly personal and confidential and must not be communicated to third parties under any circumstances, otherwise the account of the offending Registered User will be deleted. Each Registered User is personally responsible for maintaining the confidentiality of their username and password. The Company shall under no circumstances be held liable for the usurpation of a User's identity. If a User suspects fraud at any time, he/she should contact the Company as soon as possible, so that the Company can take the necessary measures and regularize the situation.

Each User, whether a legal or physical person, may only have one account on the Site.

In the event of non-compliance with the GTC/CGU, in particular the creation of several accounts for a single person or the provision of false information, the Company reserves the right to temporarily or permanently delete all accounts created by the offending User.

The deletion of the account results in the permanent loss of all benefits and services acquired on the Site. However, any Order made and invoiced by the Site before the account is deleted will be executed under normal conditions.

In the event that an account is deleted by the Company for failure to comply with the duties and obligations set out in the GTC/CGU, the offending User is strictly prohibited from re-registering on the Site directly, by means of another e-mail address or by an intermediary without the Company's express authorisation.

 

5. Ordering information

Any Order can only be placed when the User has registered on the Site. The User, when logged into his account, can add Products to his virtual shopping cart. He can then access the summary of his virtual basket to confirm the Products he wishes to order and make his Order by pressing the "Order" button.

He must provide a valid address, delivery method and payment method in order to finalize the Order and effectively form the sales contract between him and the Company. The finalization of the Order implies the acceptance of the prices of the Products sold, as well as the terms and delivery times indicated on the Site.

Once the Order has been placed, the User will receive confirmation by email. This confirmation will summarize the Order and relevant delivery information. The placing of an Order constitutes the conclusion of a distance selling contract between the Company and the Client.

 

6. Products and prices

The Products covered by the GTC/CGU are those appearing on the Site and which are sold and shipped directly by the Company.

The Products are described on the corresponding page within the Site and all their essential characteristics are mentioned. The sale is made within the limits of the Company's available stocks. The latter cannot be held responsible for stock shortages or the impossibility of selling a Product whose stock is non-existent.

When a User wishes to acquire a Product sold by the Company through the Site, the price indicated on the Product page corresponds to the price in euros, all taxes included (VAT included), excluding shipping costs and takes into account the applicable discounts in effect on the day of the Order. The price indicated does not include shipping costs, which will be detailed in the summary, if any, before placing the Order. If the total cost of the Products cannot be calculated in advance, the Company will send the Client a detailed quotation setting out the formula for calculating the price.

Under no circumstances may a User require the application of discounts no longer in effect on the day of the Order.

 

7. Secure payment and terms of payment

Unless otherwise specified, all sales are paid in cash at the time of placing the Order. JUJE reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of a difficulty concerning the order received.

Payment can be made by:

  • Credit card via the secure Payplug module
  • Paypal

 

Is my payment secure?

At the time of payment, the padlock symbol appears indicating that your connection is encrypted and secure. Authorization servers are then consulted to verify this data and prevent abuse and fraud. SSL encryption technology ensures the security of the information you provide during the banking transaction.

 

 

What are the payment methods?

All transactions on the www.juje.fr website are carried out in Euros. We accept the following credit cards as payment methods: CB, VISA, VISA, VISA ELECTRON, Mastercard, Maestro

The transaction is done on the secure Payplug platform. This solution is based on the secure 3D secure technical platform. As a result, no banking information concerning the Customer will be transmitted via the Site. Only Payplug has confidential information (card number, validity date, etc.) of the Customer, which is inaccessible to third parties.

The invoice for each Order is sent to the Customer with a summary of the Order and a copy of these GTC to the Customer or to the person designated by him with the Product. A duplicate invoice can be downloaded and/or printed in the Customer area.

 

 

My payment was refused?

8. Shipping & Returns

Checking the delivery:

JUJE guarantees the conformity of the delivered product to the essential characteristics described on the website www.juje.fr and this for a use in accordance with its purpose.

The Internet user is required to check the condition of the packaging and the conformity of the product delivered, and to make any comments or reservations on the carrier's delivery note.

 Carrier:

Delivery will be made by the Post Office (Colissimo at Home or at a Relay Point) to the address indicated by the Customer when ordering on the website https://www.juje.fr/gb/

 Delivery times:

The delivery time depends on your geographical area: the average indicative delivery time (in working days) is 48/72 hours for France, Corsica and Monaco.

It will take an additional delay for Europe: 3 to 6 days.

This delivery time does not take into account the time required to prepare the package, which depends on the items in your shopping cart. You can track the progress of your orders by logging into your JUJE customer account or by clicking on the link provided by the shipping company indicated in the shipping confirmation email.

Except in special cases or unavailability of one or more Products, the Products ordered will be delivered in a single delivery.

The Seller undertakes to make all reasonable efforts to deliver the products ordered by the Customer within the time limits specified above.

However, these deadlines are given for information only. 

In addition, the Company may not be held liable for reasons relating to the exceeding of delivery deadlines:

  • In periods of high demand, such as Christmas and New Year's Eve,
  • for delays caused by reasons of force majeure, i.e. due to the occurrence of an unforeseeable, irresistible event beyond control,
  • for facts attributable exclusively to the carrier responsible for the delivery. 

However, if the Products ordered have not been delivered within 15 days after the indicative delivery date, for any reason other than force majeure or the Customer's fault, the sale may be cancelled at the written request of the Customer under the conditions provided for in Articles L 138-2 and L 138-3 of the Consumer Code. The sums paid by the Client will then be returned to him at the latest within fourteen days following the date of termination of the contract, excluding any compensation or deduction...

JUJE is not responsible for additional taxes and service charges charged by some countries. Customers will be held responsible for any restrictions, duties, taxes and other charges levied by the destination country before placing an order. JUJE will not be liable for any duties, taxes or customs fees in any circumstances.

 If the order arrives in the country and:

- The Customer refuses the package

-No delivery attempt is made in the destination country to deliver the package

 Then JUJE reserves the right to cancel the said package and will not be responsible for any refund.

 

Choice of Relay Point:

The choice of the Relay Point is made when choosing the delivery

 In case of absence at the time of delivery:

In case of absence during the delivery driver's passage, the package is made available to you in the post office to which you are attached. You then have 10 working days from the arrival of the package at the post office to pick it up. After this period, it will be returned to us.

  9. Returns

Any request for return must be made directly via our website www.juje.fr . Any order returned without prior notice will not be processed.

Here are the steps to follow to declare your return online:

- Go to your customer area in the "My account > My order history" section. If you have not created an account on our site, please go to your "Guest Tracking" to upgrade your account in order to be able to make your return request online. The Guest Tracking link is in your shipping confirmation email.

- Click on the order related to the return request, fill in the product(s) to be returned and validate your return request.

- We review your return request to approve it or not

- Once the validation is done, you place the products in a protective packaging, close it and seal it carefully.

- Go to the delivery company of your choice to return the package to the following address, the return costs being at your expense :

We advise you to carefully keep the tracking number once the shipment has been sent, the return being under your responsibility.

After receipt and verification of the contents of your package (condition of the product, packaging,...) you will be refunded on the payment method used for your order.

The product must be returned in its original packaging, in a new condition (i.e. not washed, not used, with a label and without any damage (absence of significant damage to the packaging), at the latest within fourteen days following the communication of its decision to withdraw and accompanied by all accessories and any instructions and the indication of the invoice to which the products relate.

Any damaged or incomplete product will not be refunded or claimed.

WARNING: The return period is 14 days maximum from the receipt of your package. In this case, the return will be denied and returned to the sender. Any package received after the deadline cannot be refunded (postmark as proof)

If the Internet user wishes an exchange, he is invited to place an order directly on the website and return the original item for JUJE to proceed to its refund. We privilege this solution as processing times are much faster (especially for reimbursement) and the re-shipment costs are at the Internet user's expense in all cases.

Therefore, JUJE undertakes to reimburse the Internet user within a maximum period of 14 days from the effective return of the product and after verification of the package and the condition of the product, directly on the means of payment used.

 

Claims :

For all Orders placed on www.juje.fr, the Customer has a right of complaint of 14 days from the delivery of the Product. It is his responsibility to check the apparent condition of the Products upon delivery. In the absence of any reservations expressly made at the time of delivery, the Products are deemed to be in conformity with the Order.

To exercise this right of complaint, the Customer must send an email to the Company JUJE at contact@juje.fr with a declaration in which he expresses his reservations and complaints, accompanied by the relevant supporting documents (receipt form countersigned by the carrier, photographs...)

A complaint that does not comply with the conditions described above will not be accepted.

The Company will repair, replace or refund the Product or its components as soon as possible and at its expense, subject to the physical possibility of repairing the Product or its availability in stock.

 

Product(s) not compliant with the order :

In case of non-compliant or defective product(s), the Internet user is invited to contact JUJE by email by writing to contact@juje.fr specifying his order number and the problem encountered.

 

Customer service will advise you on the procedure to follow in this particular case.

 

10. Consumer's right of withdrawal

Pursuant to Article L 121-16 et seq. of the Consumer Code, the Internet user has a withdrawal period of fourteen days from the date of receipt of the order.

If the Internet user exercises this right of withdrawal, the product must be returned in its original packaging, in new condition (i.e. unwashed, unused, with a label and without any damage (absence of significant damage to the packaging), at the latest within fourteen days following the communication of his decision to withdraw and accompanied by all accessories and any instructions and the indication of the invoice to which the products relate.

A product that has suffered a depreciation due to excessive handling (in particular damaged, broken, returned incomplete, worn, without labelling, etc.) may not be returned. The return costs are the responsibility of the Internet user.

In the event of exercise of the right of withdrawal, the Internet user may request a refund of his order, with the exception of shipping and return costs incurred. He must therefore send a withdrawal form to the following address :

If the Internet user wishes an exchange, he is invited to place an order directly on the website and return the original item for JUJE to proceed to its refund. We prefer this solution because the processing times are much faster (especially for reimbursement) and the cost of reshipment is the responsibility of the Internet user in all cases.

Consequently, JUJE undertakes to reimburse the Internet user within a maximum period of 14 days from the effective return of the product, directly on the means of payment used.

 

11. Transfer of risk and ownership

The Company retains ownership of the Products sold until the Customer has paid the full price. The Company may therefore repossess such Products in the event of non-payment. In this case, the instalments paid will remain the property of the Company as compensation.

For Professional Customers, the transfer of risks to the Customer is effected as soon as the Company delivers the goods to the carrier. For Consumer Customers, the transfer of risks takes place upon delivery or upon collection of the goods from the store when the Customer has chosen an in-store delivery.

 

12. Legal guarantees

The Products sold on the website are guaranteed in accordance with the legal provisions of the Consumer Code and the Civil Code as reproduced below :

Article L.217-4 of the Consumer Code :
"The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.

He shall also be liable for defects in conformity resulting from packaging, assembly instructions or installation where the latter has been charged to him by the contract or has been carried out under his responsibility.”

Article L. 217-5 of the Consumer Code :
"The property is in accordance with the contract:

1° If it is suitable for the use usually expected of a similar property and, if applicable:

  • if it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model;
  • if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, in particular in advertising or labelling;

2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and that the latter has accepted"

Article 1641 of the Civil Code:
"The seller is bound by the warranty for hidden defects of the object sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have given only a lower price, if he had known them."

Any resold Product altered, modified or transformed is not covered by the warranty.

This is limited to the replacement or refund of non-conforming or defective Products. It is excluded in the event of misuse or abnormal use of the Product as well as in the event that the Product does not comply with the legislation of the country in which it is being shipped.

The Client must inform the Company of the existence of the defects within two years. The Company will proceed to remedy the Products found to be defective if possible. If the Company's liability is found to be in breach, the guarantee is limited to the amount excluding VAT paid by the Consumer for the supply of the Products.

The replacement of the Products does not extend the duration of the warranty.

 

13. Modifications

The Company reserves the right to modify the website, the GTC/CGU as well as any delivery procedure or other element that constitutes the services provided by the Company through this website.

When an Order is placed, the User is subject to the provisions of the T&Cs/TU in force at the time the Order is placed.

 

14. Personal data processing & RGPD

Registration on the website involves the processing of the Client's personal data. If the Customer refuses to process his data, he is asked to refrain from using the website.

This processing of personal data is carried out in compliance with the General Data Protection Regulation 2016/679 of 27 April 2016 and the law of June 20 2018.

In addition, in accordance with the French Data Protection Act of January 6 1978, the Client has the right to query, access, rectify, modify and oppose all his personal data at any time by directly using the form provided in the contact section of the website by choosing the subject of personal data. He can also make a request by mail and justifying his identity, to the following address: contact@juje.fr or by post by sending the letter to JUJE (BRARDA) / 41 Rue Jean Jaurès 92300 LEVALLOIS PERRET / FRANCE.

This personal data is necessary for the processing of his Order and the preparation of his invoices, if any, as well as for improving the functionalities of the website.

 

15. Sharing of collected data

The website may use third party companies to carry out certain operations. By browsing on the website, the Client accepts that third parties may have access to his data to ensure the proper functioning of the website.

These third party companies have access to the data collected only for the purpose of performing a specific task.

The website remains responsible for the processing of this data.

In addition, the User may therefore receive information or commercial offers from the Company or its partners.

The User may at any time oppose the receipt of these commercial offers by writing to the Company's address indicated above, or by clicking on the link provided for this purpose in the e-mails received.

In addition, Customer information may be transmitted to third parties without their express prior consent in order to achieve the following purposes :

  • comply with the law
  • protect any person from serious bodily harm or even death
  • fight against fraud or harm to the Company or its users
  • protect the Company's property rights.

 

16. Data protection

The Company ensures an appropriate level of security proportionate to the risks incurred and their probability, in accordance with the General Data Protection Regulation 2016/679 of April 27, 2016.

However, these measures do not in any way constitute a guarantee and do not commit the Company to an obligation of result regarding data security.

 

17. Cookies

To enable its Users to benefit from the best possible use of the website and better functioning of the various interfaces and applications, the Company may install a cookie on the User's computer. This cookie makes it possible to store information relating to browsing on the website, as well as any data entered by Users (in particular searches, login, email, password).

The User expressly authorizes the Company to place a file called a "cookie" on the user's hard disk.

The User has the possibility to block, modify the storage period, or delete this cookie via the interface of his browser. If the systematic deactivation of cookies on the User's browser prevents him from using certain services or features of the website, this dysfunction shall in no way constitute damage to the member, who shall not be entitled to any compensation as a result.

 

18. Responsibility

The Company can under no circumstances be held liable for the unavailability, whether temporary or permanent, of the website and although it uses all its means to ensure the service at all times, it may be interrupted at any time. In addition, the Company reserves the right, by a voluntary act, to make the website unavailable in order to carry out any update, improvement or maintenance operation.

As previously mentioned herein, in no event shall the Company be liable for delays in delivery for reasons beyond its control, unpredictable and irresistible or for which it cannot be held responsible.

 

19. Intellectual Property

The brand, logo and graphic design of this website are trademarks registered with the INPI and intellectual property protected by copyright, the ownership of which belongs exclusively to the Company. Any distribution, exploitation, representation, reproduction, whether partial or complete, without the express authorization of the Company will expose the offender to civil and criminal proceedings.

 

20. Jurisdiction clause

The law governing the GTS/GTU is French law. Any dispute that may arise between the Company and a User during the execution of the present contract shall be the subject of an attempt to resolve it amicably. Otherwise, disputes will be brought to the attention of the competent courts of general law.

 

21. GTS/GTU Agreement

The Customer or User expressly accepts the GTS/GTU.

The Customer declares that he is aware of this and waives the right to rely on any other document, in particular his own general terms and conditions of purchase.

The Consumer acknowledges that he/she has been informed of the information and data provided for in Articles L. 111-1 to L. 111-7 of the Consumer Code, and in particular:

  • the essential characteristics of the Product;
  • the price of the Products;
  • the date or period by which the Company undertakes to provide the Service;
  • information relating to the Company's identity (postal, telephone, electronic contact details);
  • information relating to legal and contractual guarantees and their implementation;
  • the possibility of using conventional mediation in the event of a dispute;
  • information relating to the right of withdrawal (deadline, operating procedures).
